As of April 23, 2021, Albuquerque has a Short Term Rental (STR) Ordinance in effect. Property owners must obtain a permit through the City's Division of Housing Preservation, which is valid for one year and must be renewed annually. Violations of the ordinance may result in fines of up to $2,000.

In New Mexico, late fees cannot exceed 10% of the total rent for that term, and prepaid rent may be required by a rental agreement. New Mexico has adopted the Uniform Residential Landlord and Tenant Act to create some consistency in landlord-tenant law, but some states have enacted stricter tenant rights laws beyond URLTA.

Removing Exemption G from the Exemptions section of the Lodgers Tax Statute will formalize all short-term rental properties, streamline local enforcement efforts, and create a level playing field for the entire lodging community.
