Nevada Airbnb Laws and Regulations

As of July 1, 2022, short-term rental laws went into effect in Nevada. The state business license is required in addition to county authorization, and owners must have a designated local representative available 24/7. Rentals must meet liability coverage minimums. AB 363 requires Clark County to adopt an ordinance regulating short-term rentals and accommodation facilitators, such as Airbnb and Expedia.

Under this law, short-term rental owners are prohibited from holding more than five permits, one per property. In the City of Las Vegas, short-term rentals are only allowed in owner-occupied homes that have three or fewer bedrooms and are at least 660 feet away from another short-term rental. Henderson currently requires short-term rental managers to pay an annual $820 registration fee, and applicants must submit a noise management plan as part of their registration.

No more than 25 percent of all units in a multifamily complex may be registered as short-term rentals, and planned communities have the authority to ban them outright. In general, a short-term residential rental may be allowed to operate as a conditional use if it is owner-occupied and has no more than three bedrooms.

Nevada's Department of Taxation administers short-term leases and requires entities to be registered as short-term lessors for one rental. Lastly, VHRs (vacation home rentals) have been permitted in Tahoe Township since 2005 and are properties that are rented on a short-term basis.
